The legal saga surrounding former U.S. Olympian David “Davey” Hearn and the Lincoln Memorial Reflecting Pool has taken another dramatic turn. After months of accusations and legal proceedings, a judge has agreed to drop the federal government’s vandalism case against Hearn and three others. However, the fight for justice is far from over.
Hearn, a three-time Olympic canoe slalom athlete, has consistently maintained his innocence. His legal team, led by Norm Eisen, is pushing for a permanent dismissal of the charges, arguing that the case was politically motivated and lacked sufficient evidence.

The case against Hearn has been mired in political controversy from the outset. Prosecutors initially sought to dismiss the case “without prejudice,” leaving the door open for future charges. However, Hearn’s lawyers are advocating for a dismissal “with prejudice,” which would prevent the government from refiling the case.
“From day one, the case against Mr. Hearn was motivated by political considerations and devoid of adequate factual support,” his lawyers wrote in a 28-page motion filed last week. They argue that political pressures have influenced the prosecution’s actions, undermining the integrity of the legal process.
The Evidence and the Controversy
The controversy surrounding the Lincoln Memorial Reflecting Pool has been a focal point of the case. President Trump has repeatedly claimed that vandals damaged the pool’s lining, contradicting evidence presented by U.S. Attorney Jeanine Pirro. Pirro’s 20-page legal filing blamed the peeling lining on a “botched installation,” not vandalism.
“A National Park Service career employee, a highly credible witness, saw David Hearn (ActBlue) in broad daylight vandalize the Reflecting Pool by ‘violently’ ripping and tugging at the Pool’s somewhat delicate coating,” Trump posted on Truth Social, wading back into the debate. Despite acknowledging some contractor error, Trump has continued to push the narrative of vandalism.
The Personal Toll
The legal battle has taken a significant toll on Hearn, both emotionally and physically. The 67-year-old has described his ordeal as “Kafkaesque” and “Orwellian,” expressing concerns about the state of democracy in the country he once represented in the Olympics.
“My confidence is being tested for sure here, in what our nation can withstand,” Hearn said. “But I don’t think people are taking this lying down.” He has found support from his lawyers, family, and a wide community of friends and supporters, who have rallied around him as the case has gained national attention.
What’s Next?
The legal fight is not yet over. Hearn’s lawyers are reviewing all legal remedies and have filed a motion seeking to have the indictment against him dismissed with prejudice. They argue that the government’s actions have defied both decency and common sense, and that the court should not leave Hearn subject to the possibility of renewed prosecution.
“The Court should not leave the defendant subject to the possibility of renewed prosecution,” the filing states. Hearn has a status hearing scheduled for September on the dismissal question and is feeling optimistic about the outcome.
“With the power of the law, the power of the courts, the judges and my wonderful team … I feel very well-equipped to contest this, to bring democracy back to me,” Hearn said.
