The lawsuit, which initially sought nearly $1.6 million in damages, was filed by ten parents who discovered their children’s artwork being sold online without their consent.

The controversy began in March 2024 when parents learned that their children’s classroom creations were available for purchase as prints, T-shirts, coffee mugs, and other merchandise, with prices reaching up to $113. The teacher involved, Mario Perron, was accused of profiting from his students’ work. However, the school board’s investigation revealed a different story.

Investigation findings

According to the school board’s statement, the teacher made an honest mistake while attempting to use the artwork for an educational project focused on photo editing techniques. The board clarified that the images were uploaded to Perron’s personal Pixels/Fine Arts America page in February 2024, and there was no intention to sell the artwork. The teacher inadvertently activated a marketing template that added price tags to the students’ work without his knowledge.

Resolution and apology

Upon discovering the situation, the teacher acted swiftly to rectify the issue, removing the artwork from the website as soon as he was notified. The school board emphasized that no sales occurred and that Perron did not receive any financial gain from the incident. In light of these findings, the parents decided to drop the lawsuit, which had initially sought $155,000 per parent, along with punitive damages and a formal apology from Westwood Junior High School.

The school board expressed regret for the distress caused to the students and their families, reiterating that the situation stemmed from a misunderstanding rather than any malicious intent. While the specific disciplinary action taken against the teacher was not disclosed, the board stated it was appropriate given his commitment to his students’ education.
